State tax dispute letter: Certified Mail letter template

Send this letter by Certified Mail

Pre-filled template, USPS tracking and Electronic Return Receipt

State departments of revenue issue assessments for underreported income, disputed residency, unfiled returns, or adjustments carried over from a federal audit. Each notice sets a protest window, and missing it can make the assessment final and collectible even when it is wrong.

A written dispute filed within the deadline preserves your rights. It should identify the notice, state each ground for disagreement, enclose the supporting documents, and request an administrative hearing or conference where one is available. It should also ask the agency to suspend collection on the disputed amount while the protest is reviewed.

Because everything turns on the date your protest is received, USPS Certified Mail with Electronic Return Receipt is the standard way to establish it.

Sent via USPS Certified Mail with Electronic Return Receipt

Taxpayer: [your full legal name], Account/ID: [state taxpayer account number or SSN as requested by the notice], Tax period: [tax year or period]

Dear Sir or Madam,

I am writing to formally dispute the assessment identified above in the amount of [assessed amount]. This letter constitutes my protest and request for review within the time allowed by the notice.

I dispute the assessment for the following reasons: [state the grounds: the income was not sourced to this state, the return was filed and the payment was made on X date, the adjustment duplicates income already reported, residency was established in another state as of X date, etc.].

Enclosed are copies of the notice and the documents supporting my position: [list: filed returns, W-2s or 1099s, proof of payment, residency records, prior correspondence].

Please suspend collection activity on the disputed amount while this protest is under review, and send me a written determination. If an administrative hearing or conference is available, I request one. This letter is sent via USPS Certified Mail, and the signed Electronic Return Receipt will establish the date this dispute was received.

Sincerely,

Mr. First name Last name

Frequently asked questions

Answers to the questions we hear most often about this letter.

How long do I have to dispute a state tax assessment?

The deadline is printed on the notice and varies by state, commonly 30, 60, or 90 days. A protest received after the deadline can be rejected without review of the merits, so mail early and keep dated proof of receipt.

Does collection stop while my dispute is pending?

Many states pause collection on amounts disputed within the protest window, but the rules vary. This template expressly requests suspension of collection in writing, which puts the question on the record.

What evidence helps in a residency dispute?

Documents that fix your domicile and physical presence: lease or deed, driver's license and voter registration, utility bills, school records, and the filing history in your actual state of residence. Attach copies, never originals.

What if the state denies my protest?

Most states provide a further level of review, such as a tax tribunal, board of appeals, or court action, each with its own deadline. The written record you build at the protest stage, including proof of mailing, follows the case through every level.
