HOA records inspection request: Certified Mail letter template

Send this letter by Certified Mail

Pre-filled template, USPS tracking and Electronic Return Receipt

State laws governing common interest communities give members the right to inspect association records: budgets, financial statements, meeting minutes, vendor contracts, reserve studies, insurance policies, and the assessment ledger for their own account.

A written request defines what you want and starts the statutory response period. Some states require a purpose statement for certain records; this template includes one and offers to pay the reasonable copying costs the law permits, removing the association's standard objections in advance.

If a record is withheld, the template requires the association to identify it and state the basis in writing, which frames any later challenge. Certified Mail with Electronic Return Receipt dates the request and the deadline that flows from it.

This template is provided for informational purposes only and is not legal advice.

Frequently asked questions

Answers to the questions we hear most often about this letter.

Which records can members inspect?

Commonly: budgets, financial statements, board and membership minutes, contracts, reserve studies, insurance policies, and your own assessment ledger. Statutes typically protect certain records, such as personnel matters, pending litigation, and other owners' private information.

Can the association refuse my request?

Only on grounds recognized by the governing documents or state law, and it should say which record is withheld and why. A blanket refusal of a proper written request is the strongest fact you can bring to an ombudsman, regulator, or court.

How quickly must records be produced?

State deadlines commonly run about 10 business days from receipt, with variations. The template asks for production within the statutory period, or within 10 business days if none is specified, counted from the date on the Electronic Return Receipt.

Can I be charged for copies?

Associations can usually charge reasonable copying costs, but not for the right of inspection itself. Accepting electronic copies, as the template does, often reduces the cost to zero.
