Notice of Intent to Withhold Rent: Certified Mail letter template

Some states allow tenants to withhold rent, or pay it into escrow, when a landlord fails to fix serious habitability problems after proper notice. It is one of the strongest tenant remedies, and one of the most dangerous to use incorrectly: withholding in a state that does not allow it, or without the required prior notice, can lead to eviction for non-payment.
Where withholding is lawful, the sequence matters: written notice of the defects, a reasonable time to repair, then written notice of your intent to withhold. Each letter sent via USPS Certified Mail with Electronic Return Receipt gives you the dated, signed proof of notice that courts require before they will protect a withholding tenant.

Dear Sir or Madam,
I am the tenant of the rental unit located at [full address of the rental unit]. On [date(s) of prior notice], I notified you in writing of the following conditions affecting the habitability of the unit: [list the problems and reference your earlier letters or reports]. As of today, these conditions have not been corrected.
Under [state statute or legal provision permitting rent withholding, if known], tenants in my state may withhold rent, or a portion of it, when a landlord fails to correct serious habitability defects after proper notice.
