Most deposit disputes come down to the condition of the unit, and the tenant who documents it wins. Several states, including California, give tenants a right to an initial move-out inspection before the tenancy ends, with an itemized list of proposed deductions and a chance to fix them before they cost you money.

Dear Sir or Madam,

 

I am the tenant of the rental unit located at [full address of the rental unit]. As stated in my notice dated [date of your notice to vacate or non-renewal], my tenancy ends on [move-out date].

 

I request that we conduct a joint move-out inspection of the unit before I return the keys. I propose [two or three proposed dates and times], and I am open to alternatives that suit your schedule. In some states, landlords are required to offer an initial inspection before move-out and to give the tenant an itemized list of proposed deductions, so the tenant has an opportunity to remedy them.

 

During the inspection, I would like us to complete and sign a written condition checklist, compare it with the move-in checklist dated [date of the move-in inspection, if any], and take photographs of each room.

Is my landlord required to do a move-out inspection?

In some states, yes, upon the tenant's request; in others there is no requirement. Even where optional, most landlords will agree, and a refusal that you can prove tends to undermine their later deduction claims in small claims court.

What should I bring to the walkthrough?

The move-in checklist and photos if you have them, a copy of your lease, a camera, and a written checklist to complete room by room. Ask the landlord to sign and date the completed checklist, and photograph anything either of you flags.

Can I fix problems the landlord identifies?

That is the point of an early inspection: in states that require one, you generally get the chance to remedy identified issues before move-out and avoid the deduction. Keep receipts for any cleaning or repairs you complete.
